Traffic Ticket Deferral Program

PLEASE READ BEFORE PAYING ANY TRAFFIC TICKET

The Boone County Prosecutor’s Office offers an Infraction Deferral Program to eligible drivers who are cited for certain traffic offenses.

The program provides an opportunity to have the traffic ticket dismissed upon the successful completion of the deferral program. Participation in the program will require drivers to enter into an agreement and successfully complete the terms of that agreement. Terms of the agreement may vary, but typically include paying the deferral fee, completing an online class through our approved provider and not receiving any other tickets for the length of the deferral program. Eligibility is at the discretion of the Boone County Prosecutor’s Office.

ELIGIBILITY REQUIREMENTS FOR PARTICIPANTS

  • HAVE NOT ADMITTED OR PAID THE TICKET
  • Do not have a commercial driver’s license
  • Have received a ticket in Boone County, Indiana
  • Be at least 16 years old
  • Eligibility is at the discretion and determination of the Boone County Prosecutor’s Office

Common Infractions that May Qualify

  • Speeding
  • Disregarding traffic signals or stop signs
  • Driving left of center
  • Passing in the “No Passing” zone
  • Following too closely
  • Failure to yield
  • Failure to signal

Deferral Process

Upon approval, you will be asked to sign a Deferral Agreement, attend an online class, and pay the Deferral Costs. If you are interested in a deferral, make sure you do not pay your ticket through the court, as once the ticket is paid and sent to the BMV, there is nothing that can be done to reverse the process.

Any paperwork, classes, and fees must be processed by the due date listed on your ticket unless an extension is approved by the Prosecutor’s Office. Upon confirmation of your eligibility, you will receive additional instructions from the Boone County Prosecutor’s Office. Failure to have your paperwork submitted or to appear in court on the specified date may result in a default judgement.
