Permits

The Boone County Highway Department is responsible for administering all permits that are required for various activities taking place on public roads or within public rights of way that are under the jurisdiction of the Boone County Board of Commissioners.  Information regarding each of these permits is outlined below.  Questions or completed applications can be submitted via email to highwaypermits@co.boone.in.us.     

 

All County Highway permit fees must be paid with a Check or Money Order made out to the Boone County Highway Department.  The Boone County Highway Department is currently developing processes to enable applicants to pay fees with credit card in the near future.

Schedules of Fees and Bonds

The following links include a list of permit fees and the required bonding amounts for each type of permit.  These schedules of fees and bonding amounts were adopted by the Boone County Board of Commissioners on September 5, 2017 and are in effect after January 1, 2018.

Work in Right of Way Permit

Permits are required by the Boone County Board of Commissioners whenever working in county right of ways or on any county roads. Failing to obtain a permit will constitute a violation from the Highway Department and the Boone County Board of Commissioners.  All right of way permits must first be approved by the Boone County Highway Department before being heard by the Board of Commissioners at a regular scheduled meeting.  In many instances, the Ordinance requires the applicant to submit a permit bond prior to the approval of a right of way permit. 

 

If the applicant also plans to close a County Road to perform the work in the right-of-way, a separate Road Closure permit must be completed and submitted to the Boone County Highway Department. 

 

The schedules of fees and schedule of bonds below outline fee and bonding requirements for various types of work effective January 1, 2018. 

 

Approval of a right of way permit does not guarantee the approval of other permits that may be required by other County or Governmental entities.

Road Closure Permit

Permits are required by the Boone County Board of Commissioners whenever a county road will be closed.  Failing to obtain a permit will constitute a violation from the Highway Department and the Boone County Board of Commissioners.  All road closure permits must first be approved by the Boone County Highway Department before being heard by the Board of Commissioners at a regular scheduled meeting.  There is no charge to apply for the closure of a County Roadway.   

 

Approval of a road closure permit does not guarantee the approval of other permits that may be required by other County or Governmental entities.

Driveway Permits

Permits are required by the Boone County Highway Department whenever constructing any privately owned commercial or residential drive or any field entrance onto county roads.  All driveway permits must be approved by the Boone County Highway Department before constructing the new drive.  All costs associated with the construction and maintenance of permitted driveways & field entrances, including drive culverts is the responsibility of the drive owner. 

 

Driveway permits remain active for one year or until a final inspection is performed and the work is accepted.  Where building permits are issued, a certificate of occupancy will not be granted until the drive construction is approved and accepted by the Boone County Highway Department.

Field Entrance = $25.00 each

Residential Drive = $150.00 each

Commercial Drive = $250.00 each

Dust Control Permit

A dust control permit is required for any property owner wishing to place dust control on the gravel road adjacent to their property.  The purpose of the permit is to notify the Highway Department of the location so our grader operators can prepare the roadway in advance and avoid grading through the area during the summer months.  Dust control is not permitted before May 1st or after August 30th.

Frost Permit

Any vehicle* with a total loaded gross weight in excess of 24,000 pounds must obtain a permit through the Boone County Highway Department in order to use any road within the jurisdiction of the Boone County Highway Department between January 1st and April 30th of any year.

            Permit Fee =$0.00

*Exception:  School or church buses, vehicles or equipment owned by Boone County, or to residential or agricultural deliveries

Off Road Vehicle Permit

Per Ordinance 2015-5, the operation of permitted Off-Road Vehicles is allowed on the public rights-of-way of Boone County, including the paved or unpaved travel portions of County Roads.  The Off-Road Vehicles must be annually registered with the Boone County Highway Department.  The registration sticker must be visibly displayed on the vehicle.  Proof of Insurance and BMV registration must be presented annually to obtain a permit.

Annual Permit Fee =$25.00
